These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "User", "Business User") and Lucas Tohmeh trading as JobUp ("JobUp", "we", "us", "our") governing your access to and use of the JobUp mobile application ("App"), the JobUp website at getjobup.com ("Website"), the JobUp customer portal ("Portal"), and our application programming interface ("API") (together, the "Services").
By creating an account, downloading the App, or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (available at https://getjobup.com/privacy). If you do not agree to these Terms, you must not use our Services.
If you are using the Services on behalf of a business, you represent and warrant that you have the authority to bind that business to these Terms.
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you are at least 18 years old.
JobUp is a mobile-first job management platform designed for sole traders and small trade or service businesses operating in Australia. The Services include:
JobUp is a software platform. We are not an accounting service, a financial advisor, a legal advisor, or a telecommunications provider. We provide tools to help you manage your business — the responsibility for your business operations, tax obligations, and compliance with applicable laws remains with you.
To use the Services, you must create an account by providing a valid email address and creating a password, or by authenticating via Apple Sign In or Google Sign In.
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must:
We are not liable for any loss or damage arising from your failure to secure your account credentials.
Each JobUp account is associated with a single business. You may not create multiple accounts for the same business or share a single account across unrelated businesses.
JobUp offers multiple subscription tiers with varying features and limits. Plan details, features, and pricing are displayed within the App and on our Website. We reserve the right to modify plan features and pricing at any time, with reasonable notice to existing subscribers.
The free tier provides limited access to the Services as described in the App. The free tier may have restrictions on the number of jobs per month, SMS messages, and available features. We reserve the right to modify or discontinue the free tier at any time.
Paid subscriptions are processed through Apple's in-app purchase system ("IAP"). By purchasing a subscription, you also agree to Apple's terms and conditions for in-app purchases.
Some plans include a monthly allocation of SMS messages. SMS messages that exceed your plan's allocation may be subject to additional charges or may not be sent until the next billing cycle. SMS allocations do not roll over between billing periods.
If you cancel a paid subscription or it expires, your account will revert to the free tier. You will retain access to your data, but features exclusive to paid tiers will be unavailable. If your data exceeds free tier limits, you will not be able to create new records until you either upgrade or reduce your data within the free tier limits.
You may use the Services solely for the purpose of managing legitimate trade or service business operations in Australia. You must use the Services in compliance with all applicable laws and regulations, including but not limited to:

We reserve the right to suspend or terminate your access to SMS features if we reasonably believe you are using them in violation of the Spam Act or these Terms.
You retain ownership of all data and content you upload, enter, or generate through the Services ("Your Data"). This includes business information, customer records, job details, quotes, invoices, notes, photos, and any other content.
We do not claim any ownership rights over Your Data.
By using the Services, you grant us a limited, non-exclusive, royalty-free licence to use, store, process, and display Your Data solely for the purpose of providing and improving the Services. This licence continues for as long as Your Data is stored on our systems.
You are responsible for the accuracy and legality of all customer data you enter into JobUp. You represent and warrant that:
You may export Your Data from the Services at any time through the App's export features or by contacting us at [email protected]. We will provide your data in a commonly used, machine-readable format within a reasonable timeframe.
You may delete individual records (customers, jobs, quotes, invoices) through the App. Deleted records are soft-deleted for 90 days (to allow recovery) and then permanently deleted.
You may request complete deletion of your account and all associated data by contacting us at [email protected]. We will process account deletion requests within 30 days, subject to our legal obligations to retain certain records (such as financial records required by the ATO for a minimum of 5 years).
We maintain automated backups of all data stored in our systems. Backups are retained for disaster recovery purposes and are subject to the same security measures as live data. Backups containing deleted data are purged in accordance with our retention schedule.

The Xero integration is optional and initiated by you. You may disconnect Xero at any time through the App settings, which will revoke our access to your Xero account.
Your use of Xero is subject to Xero's own terms of service and privacy policy. We are not responsible for the availability, accuracy, or security of Xero's services.
We may offer additional third-party integrations in the future. Each integration will be optional and will require your explicit authorisation before any data is shared with the third party.
The Services, including the App, Website, Portal, API, and all associated software, designs, text, graphics, logos, trademarks, and other materials ("Our IP"), are owned by or licensed to JobUp and are protected by Australian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Services in accordance with these Terms. This licence does not include any right to:
If you provide us with feedback, suggestions, or ideas about the Services, you grant us an unrestricted, irrevocable, non-exclusive, royalty-free licence to use, modify, and incorporate that feedback into the Services without any obligation or compensation to you.
The customer portal allows your customers to view quotes, invoices, and booking details via secure links. Portal access does not require your customers to create an account.
We will use reasonable efforts to keep the customer portal available, but we do not guarantee uninterrupted access. We are not liable for any loss or damage caused by portal downtime.
The content displayed on the customer portal is generated from data you enter into JobUp. You are responsible for ensuring the accuracy of this content, including business details, pricing, terms, and customer information.
To the maximum extent permitted by law, the Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
If the Australian Consumer Law applies to you as a consumer, our liability for a failure to comply with a consumer guarantee is limited to, at our election:

You are liable for any loss, damage, or cost (including legal costs) we incur as a result of your breach of these Terms, your violation of any law, or your negligent or wrongful acts or omissions.
You agree to indemnify, defend, and hold harmless JobUp and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

We may suspend or terminate your access to the Services, in whole or in part, at any time and for any reason, including if:
Where reasonably practicable, we will provide you with prior notice and an opportunity to remedy any breach before suspension or termination.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. We will use reasonable efforts to provide advance notice of material changes.
We are not liable to you or any third party for any modification, suspension, or discontinuation of the Services.

Your continued use of the Services after the updated Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services and terminate your account.
Before commencing any formal dispute resolution proceedings, you agree to first contact us at [email protected] and attempt to resolve the dispute informally. We will endeavour to resolve any dispute within 30 days of receiving your written notice.
If the dispute is not resolved informally within 30 days, either party may refer the dispute to mediation administered by the Australian Disputes Centre (ADC) in Sydney, New South Wales, in accordance with the ADC's mediation guidelines. The costs of mediation will be shared equally between the parties, unless the mediator determines otherwise.
If the dispute is not resolved through mediation, either party may commence court proceedings in the courts of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.
Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief from a court of competent jurisdiction.
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, and the Commonwealth of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales.
These Terms, together with our Privacy Policy and any plan-specific terms displayed in the App, constitute the entire agreement between you and JobUp with respect to the Services and supersede all prior or contemporaneous communications, whether electronic, oral, or written.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, it will be severed from these Terms. The remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. A waiver of any right or provision is only effective if it is in writing and signed by an authorised representative of JobUp.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to any third party without your consent, provided the assignee agrees to be bound by these Terms.
Notices to you may be made via email to the email address associated with your account, via push notification, or via in-app notification. Notices to us should be sent to [email protected] or by post to our registered business address.
We are not liable for any failure or delay in performing our obligations under these Terms if the failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, telecommunications failures, power outages, third-party service provider outages, or pandemic.
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and JobUp. You are an independent user of the Services and are not an agent, partner, or employee of JobUp.
These Terms do not confer any rights on any person or entity other than the parties to these Terms, except as expressly stated.
